Terms and Conditions

These Terms and Conditions govern all agreements, services, and transactions between BiHosting Internet Services ("BiHosting", "we", "our", or "us") and the customer ("you", "your"). By placing an order, you confirm that you have read, understood, and accepted these Terms.

1. Orders and Delivery

Orders can be placed through our website. Immediate payment is not mandatory, but payment must be completed before the service is activated.

Customers may cancel subscriptions at any time. Unless otherwise stated, services are non-binding.

Delivery times shown on our website are estimates. Delays may occur due to stock shortages or technical issues.

If a server is out of stock, BiHosting will deliver within 8 calendar days. If delivery is not possible within this period, a full refund will be provided.

Custom orders (including special setups or configurations) are non-refundable due to setup costs.

BiHosting will make commercially reasonable efforts to maintain sufficient stock at all times.

2. IT Services (Game Servers, VPS, and Dedicated Servers)

2.1 Acceptable Use

You may not use our services for unlawful purposes such as DDoS/DoS attacks, hosting illegal content, copyright infringement, or fraud.

Spam or unsolicited bulk messaging is strictly prohibited.

Using services as a proxy, VPN exit node, or tunneling endpoint without prior written permission is prohibited.

Cryptocurrency mining is not allowed.

2.2 Security, Content, and Compliance

The customer is solely responsible for all hosted content, data, and software.

We reserve the right to suspend services upon legal request or if content is believed to be harmful.

Maintaining account and system password security is the customer’s responsibility.

2.3 Data and Backups

BiHosting is not responsible for data loss. Backup responsibility belongs to the customer.

Backups generated from the control panel are retained for up to 2 months.

After service expiration, data may be permanently deleted after 3 days.

2.4 Resource Usage and Performance

A fair usage policy applies to VPS services. Resource limits may be enforced in cases of excessive usage affecting other customers.

BiHosting is not responsible for performance impacts caused by third-party plugins or mods.

3. Support

Support requests can be submitted via Discord or through our support email address.

Standard response time is 24 hours, though responses are often faster.

Support is limited to BiHosting infrastructure; third-party software support is not included.

4. Refunds and Right of Withdrawal

By placing an order, you accept the refund policy.

Refunds are not provided for customer-caused misconfigurations.

Since digital services are activated immediately, the right of withdrawal is deemed waived once service begins (in line with applicable consumer regulations).

Approved refunds are processed within 7 business days.

If a dispute is opened directly via PayPal or credit card, BiHosting reserves the right to immediately suspend and remove related services.

5. Force Majeure

BiHosting is not liable for service interruptions caused by circumstances beyond its control, including natural disasters, war, cyberattacks (including DDoS), or power outages.

6. Donations and Credits

BiHosting may offer a donation system to support server costs.

Credits obtained through donations are usable only for platform services and cannot be converted to cash or refunded.

7. Data Protection (KVKK/GDPR Compliance)

BiHosting collects personal data such as name, email, and IP address as required for service delivery.

Data is not shared with third parties except where required by law or necessary for service execution. Personal data is never sold.

Customers have the right to request deletion or correction of their personal data.

8. Changes to the Terms

BiHosting may update these terms at any time.

Important changes will be announced on our website.

9. Governing Law

These terms and any disputes arising from them are governed by the jurisdiction of the relevant courts and the laws of Turkey, unless otherwise specified (or by the place where the company is officially headquartered).
